Acceptance of Terms

By accessing or using our numismatic management system (the "Service"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Service.

Intellectual Property & Data Ownership

  • Our Property: We retain all rights, title, and interest in the Service, including the codebase, the AI scanning algorithms, the UI/UX, and the Master Research Database.
  • Your Data: You retain full ownership of all data, images, and inventory logs you upload to your personal vault. You grant us a limited, secure license to host, process, and display this data solely for the purpose of providing the Service to you.
  • Research Packs (DLC): Purchasing a "Research Pack" grants you a non-exclusive, revocable license to access our premium curated data. It does not grant you ownership of the underlying data, and you may not scrape, copy, resell, or distribute this data outside the Service.

Payments, Subscriptions & Tokens

  • Subscriptions: Pro Tier subscriptions are billed in advance on a recurring basis. You may cancel your subscription at any time via your account dashboard. Upon cancellation, your access will remain active until the end of your current paid billing cycle.
  • Tokens: "AI Tokens" are consumed when utilizing the AI Vision scanner or advanced scraper tools. Monthly tokens allocated via subscription reset at the end of each billing cycle and do not roll over. Purchased top-up tokens hold no real-world cash value.
  • Strict No-Refund Policy: Due to the immediate digital access and third-party API costs incurred by the Service, all purchases, subscriptions, Research Packs, and AI Token top-ups are strictly non-refundable. We do not offer prorated refunds for canceled subscriptions, accidental purchases, or unused tokens, except where explicitly required by Australian Consumer Law.

Confidentiality & Privacy

We respect your privacy and the confidentiality of your personal collection. We implement multi-tenant security to isolate your data. How we collect, store, and process your personal and payment information is strictly governed by our accompanying Privacy Policy.

Limitation of Liability & Valuations

  • "As Is" Basis: The Service, including all AI identifications and market tracking features, is provided "as is" and "as available." We do not guarantee 100% uptime, nor do we guarantee the accuracy of any third-party data provided.
  • Not Certified Appraisers: CoinData is a technology platform, not a certified numismatic appraisal service. Any identifications, condition grades, or valuations generated by our AI Vision tools or data scrapers are estimates based on algorithmic matching and public data.
  • No Financial Advice: All valuations, eBay sales data, and market research provided by the Service are for informational and entertainment purposes only. They do not constitute financial, investment, or legal advice. You assume all risk and liability for any purchases, sales, or financial decisions made based on data from the Service.
  • Liability Cap: To the maximum extent permitted by law, our total liability for any claims arising from the use of the Service (including data loss or financial loss resulting from inaccurate valuations) shall not exceed the total amount you paid us in the twelve (12) months preceding the claim.

Third-Party Services & AI Providers

The Service integrates with third-party providers (including, but not limited to, Stripe for payments, OpenAI for artificial intelligence processing, and eBay for live auction data). We do not control these third-party services.

  • We are not liable for their availability, accuracy, or any damages arising from your use of them.
  • You acknowledge that images submitted to the AI Scanner may be temporarily processed by third-party vision models (e.g., OpenAI). By using the scanner, you consent to this processing.
  • We explicitly disclaim any responsibility for "AI hallucinations," inaccurate condition grading, or incorrect coin identifications provided by the automated system.

User Accounts & Security

To access certain features, you must register for an account. You must provide accurate information and are solely responsible for safeguarding your login credentials. You agree not to share your account access with third parties. You must notify us immediately of any unauthorized use of your account.

Acceptable Use Policy

You agree not to misuse the Service. This includes, but is not limited to:

  • Reverse-engineering, decompiling, or attempting to extract the source code or AI algorithms.
  • Using automated bots, scrapers, or crawlers to extract data from our Master Research Database.
  • Uploading malicious code, viruses, or illegal content.
  • Reselling or sub-licensing your account access or the data provided by the Service.

Termination

We reserve the right to suspend or terminate your account and your access to the Service at our sole discretion, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Service will immediately cease.

Indemnification

You agree to indemnify, defend, and hold harmless us and our affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your use of and access to the Service, or your violation of any term of these Terms.

Force Majeure

We shall not be held liable for any failure or delay in performing our obligations where such failure results from any cause beyond our reasonable control, including but not limited to acts of God, internet service provider failures, third-party API outages (e.g., OpenAI or Stripe), natural disasters, or government actions.

No Assignment of Rights

You may not assign, sell, or transfer your account, subscription, tokens, or any of your rights under these Terms to any third party without our prior written consent. We may assign our rights and obligations under these Terms at our discretion.

Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Western Australia. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Western Australia.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any material changes by posting the new Terms on this site. Your continued use of the Service following the posting of any changes constitutes acceptance of those changes.
